The Multistate Tax Commission and the states are currently offering an amnesty program for Amazon sellers who want to self-identify to start collecting sales tax.  While it sounds generous to forgive so much in back taxes,it’s not the Amazon seller’s legal responsibility to collect in the first place.  Why have 24 states chosen to burden hundreds of thousands of sellers when the law says it’s Amazon’s burden?

In this breakout session we will review the MTC’s Amnesty program for Amazon sellers, and how the seller community ended up being put in the position where states have chosen to place the tax burden on us rather than Amazon.  We will explore the legal basis for why it’s clearly Amazon’s burden and not yours, as well as what’s at stake for Amazon. We will also look at the ongoing South Carolina Amazon sales tax litigation, and what it means for sellers.

In addition to sales & use tax, we will discuss the income and franchise tax implications of this amnesty program, and how states are extremely eager to get you to pay these taxes, even though legally they may not actually be able to.  Finally, we will discuss how we plan to fight back against the MTC, legally and politically, and force the states to back down.
